Now that a Sacramento jury has rendered a felony conviction in a criminal case that raised questions over reasonable personal use for medical pot, a major test stirs in San Diego over whether marijuana collectives are illegal sales operations.

Undercover police officers with physicians' recommendations for medicinal weed targeted Donna Lambert, a 49-year-old cancer survivor who ran a marijuana network that provided home deliveries to medical users.

Now Lambert, who operated "The Women's Health Cooperative," is due to go on trial April 13 on seven felony counts, including illegal sales of marijuana.

I believe that this latest conviction in a Sacramento court will be overturned.

The California Supreme Court recently ruled that it was illegal for counties and cities to set their limits on the amounts of MM proscribed to patients in their jurisdictions.

The wider issue of these pig cops flouting initiatives passed by the voters of California (twice) is grounds for prosecution for these rogue cops. Follow state laws or go to jail. The same goes for rogue DA's trying to get re-elected.

I certainly hope the voters pass the legalization initiative this fall. Or better yet, the bill working it's way through the Calif. Assembly right now.

It look like that San Deigo is looking for a law suit just as L.A. has.

L.A. marijuana dispensary law challenged in court (Reuters)

Medical marijuana activists filed suit on Tuesday seeking to block a new Los Angeles ordinance they say is overly restrictive and would force virtually every pot dispensary in the city to close.
